Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you" or "your") and Percentyle ("Percentyle", "we", "us" or "our"), an independent study tool operated by its creator. They govern your access to and use of the Percentyle website at percentyle.in and its related subdomains, together with all features, content and services offered through it (the "Service"). Please read them carefully.

By creating an account, signing in, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Service.

1. About the Service

Percentyle is a personal, self-built educational tool for candidates preparing for the Common Admission Test ("CAT") and similar aptitude examinations. It offers practice questions, mock and sectional tests, a spaced-repetition error log, a vocabulary builder, analytics, a study planner and an optional AI study assistant. The Service is intended for private self-study and revision only. It is an aid to your preparation and nothing more.

2. Independence and non-affiliation

"CAT" and all other names, logos and marks referred to on the Service are the property of their respective owners and are used only for identification, commentary and educational reference. Any reference to such names does not imply any association, sponsorship or approval.

3. Eligibility

You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 to use the Service. By using the Service you represent and warrant that you meet these requirements and that the information you provide is accurate and current. The Service is not directed at children, and we do not knowingly collect data from anyone under 18.

4. Your account

4.1 Some features require you to sign in. Authentication is provided through a third-party provider (currently Supabase, including sign-in with Google). You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

4.2 You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorised use of your account at hello@percentyle.in.

4.3 Your account is personal to you. You may not share, sell or transfer it, and you may not maintain more than one account to circumvent any limit or restriction.

5. Educational content and intellectual property

5.1 The Service includes previous-year CAT questions and other examination questions reproduced for the limited purpose of private study, research, review, criticism and education. To the extent such material is protected by copyright, it is used in good faith as fair dealing under Section 52 of the Copyright Act, 1957, and remains the property of its respective rights holders.

5.2 All original material created by us, including the layout, design, code, written explanations, generated drills, and the selection, compilation and arrangement of content, together with the "Percentyle" name and overall look and feel, is owned by us or our licensors and is protected by applicable intellectual property laws.

5.3 If you are a rights holder and believe any content infringes your rights, contact us at hello@percentyle.in with sufficient detail, and we will review and, where appropriate, remove the material promptly.

6. Licence and restrictions

6.1 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for your own non-commercial preparation.

6.2 You agree that you will not, and will not permit anyone else to:

• copy, scrape, harvest, crawl, mirror, bulk-download, republish, distribute, sell, licence or otherwise commercially exploit any part of the Service or its content;
• use any robot, scraper, script or automated means to access the Service, or to access the AI assistant other than through its ordinary interface;
• circumvent, disable or interfere with any security, rate-limiting or access-control feature;
• reverse engineer, decompile or attempt to derive source code, except to the extent this restriction is prohibited by law;
• upload or transmit any unlawful, infringing, harmful or malicious content, or use the Service to break any law or infringe the rights of others;
• impersonate any person or misrepresent your affiliation with any person or entity;
• use the Service in any way that could damage, disable, overburden or impair it, or interfere with any other user's use of it.

7. Your content and data

7.1 You retain ownership of the content you create within the Service, such as your notes, saved words, bookmarks and answers ("Your Content").

7.2 You grant us a limited licence to store, process, transmit and display Your Content solely to operate the Service for you, for example to sync your progress across your devices. We do not claim ownership of Your Content and we do not sell it.

7.3 You are responsible for Your Content and for keeping your own backup of anything important to you.

8. The AI assistant

8.1 The Service may offer an AI assistant that generates responses using a third-party large-language-model provider (currently Groq).

8.2 AI-generated responses are produced automatically and may be inaccurate, incomplete, outdated or misleading, and may occasionally state incorrect information with apparent confidence. They are provided for study assistance only and do not constitute professional, legal, financial, educational or career advice.

8.3 You must independently verify anything important before relying on it. We make no warranty as to the accuracy or suitability of any AI output and accept no liability for your reliance on it.

8.4 When you use the assistant, your message is transmitted to the AI provider to generate a reply. Do not submit sensitive personal information through it. The provider's processing is governed by its own terms.

9. No guarantee of results

The Service is an educational aid only. We do not promise, guarantee or represent that using it will lead to any particular score, percentile, rank, shortlist, admission or other outcome. Any score projection, percentile estimate, difficulty rating or recommendation shown in the Service is indicative only, is generated from limited data, and must not be relied upon as a prediction. Your results depend on many factors outside our control.

10. Third-party services

The Service relies on third parties to function, including Supabase (authentication and database), Groq (AI), Vercel (hosting), Google (sign-in), and public dictionary and word services (such as dictionaryapi.dev and the Datamuse API). Your use of those features may also be subject to the relevant third party's own terms and privacy policies. We do not control and are not responsible for third-party services, and their availability is not guaranteed.

11. Fees and future changes

The Service is currently provided free of charge. We may, at our discretion and with reasonable notice, introduce paid plans or charge for some features in future. We are under no obligation to keep any feature free, and your use of any paid feature will be subject to the pricing and additional terms presented to you at that time.

12. Availability and changes to the Service

The Service is provided on an "as-is" and "as-available" basis and may include features that are experimental or in beta. We may add, change, suspend, limit or discontinue any part of the Service at any time without liability, and we do not warrant that the Service will be uninterrupted, timely, error-free or secure.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. You use the Service at your own risk.

14. Limitation of liability

14.1 To the maximum extent permitted by law, in no event will Percentyle or its creator be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, opportunity, goodwill or examination outcome, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.

14.2 To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us, if any, for the Service in the three months before the event giving rise to the claim, or one hundred Indian Rupees (Rs. 100).

14.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

15. Indemnity

You agree to indemnify and hold harmless Percentyle and its creator from and against any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

16. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will survive.

17. Privacy

Our handling of your data is described in our Privacy Policy, which forms part of these Terms. By using the Service you also agree to that policy.

18. Changes to these Terms

We may revise these Terms from time to time. The "last updated" date above shows when they last changed. Material changes take effect when posted, and your continued use of the Service after that constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service.

19. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law rules. Subject to applicable law, you agree that the courts of competent jurisdiction in India will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

20. Grievances and contact

For any question, complaint or grievance regarding the Service, your data, or content you believe is unlawful or infringing, you may contact the operator at hello@percentyle.in. We will acknowledge and make reasonable efforts to resolve grievances in accordance with applicable Indian law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

21. General

21.1 These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior understanding.

21.2 If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be applied to the maximum extent permitted by law.

21.3 Our failure to enforce any right or provision is not a waiver of it.

21.4 You may not assign or transfer these Terms; we may assign them to a successor of the Service.

21.5 We are not liable for any failure or delay caused by events beyond our reasonable control (force majeure).

21.6 Nothing in these Terms creates any partnership, agency, employment or joint venture between you and us.
